Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Mandarin Mosaic mobile application, website, and related services (together, the "Service") operated by Mandarin Mosaic ("we", "us", "our"). By creating an account, downloading the app, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

The Service is a language-learning platform for Chinese (Mandarin). It includes vocabulary and sentence study tools, flashcards, an AI article generation feature, and other learning aids. Different parts of the Service may be subject to additional terms, which are set out in the sections below.

1. Definitions

• "Account" means the personal account you create to access the Service.
• "Content" means any text, articles, sentences, vocabulary, audio, images, prompts, or other material made available through or submitted to the Service.
• "Generated Article" means a Chinese-language article produced by the AI article generation feature.
• "Premium Subscription" means a paid subscription tier that unlocks additional features such as cloud sync and credits for the AI article generation feature.

2. Account Registration

• To use the Service you must register an Account using a valid email address.
• You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your Account.
• You must provide accurate information when registering and keep your details up to date.
• You may not create multiple Accounts to circumvent credit limits, free trials, or other restrictions of the Service.
• You must be at least 13 years old to create an Account. Users under the age of digital consent in their jurisdiction should only use the Service with parental or guardian supervision.

3. Subscriptions, Payments, and Refunds

• Some features of the Service are free; others require a Premium Subscription or one-off payment (for example, additional credit packs).
• Subscriptions are billed in advance on a recurring basis (monthly or annually) and automatically renew unless cancelled before the next billing date.
• Where you purchase a subscription or credits through the Apple App Store, Google Play, or another third-party platform, the payment and refund policies of that platform also apply and may take precedence over the refund terms below.
• We may change subscription prices, credit allocations, or feature availability from time to time. We will give reasonable notice of any material change.
• Except where required by applicable consumer protection law, subscription fees and credits already consumed are non-refundable.

4. Free and Premium Features

• Free users may access a defined subset of the Service. Some content, sync features, and AI generation capacity are reserved for Premium subscribers.
• Premium subscribers receive cloud sync of their custom packs, sentences, and vocabulary across devices logged in to the same Account.
• We make reasonable efforts to keep cloud-synced data safe but you are encouraged to keep your own backups of any data you consider important.

5. AI Article Generation

5.1 Purpose and family-friendly nature

• Mandarin Mosaic provides an AI article generation feature (the "Feature") to help you practise reading Chinese at a level appropriate to your ability.
• Mandarin Mosaic is a family-friendly language-learning platform. Articles generated through the Feature must be appropriate for learners of all ages, including children. Content that would not be suitable for a school classroom is not permitted.
• The Feature is provided as a language-learning aid only. It is not a translation service, a news service, or a publishing platform.

5.2 How the Feature works

Articles may be generated in three ways:

• (a) From external content you provide — you may submit a URL or pasted text from a third-party source (for example, a news article or blog post), and the Feature will produce a simplified Chinese-language version at your chosen HSK level. These articles are personal-use only and are governed by clause 5.5.
• (b) From a prompt you write — you may describe a topic, theme, or story idea, and the Feature will generate an original article. These articles are governed by clause 5.6.
• (c) From the Mandarin Mosaic library — you may select an existing Mandarin Mosaic article and request a simplified version at your chosen HSK level. These articles are governed by clause 5.6.

5.3 Credits and usage

• Use of the Feature is metered through credits. Credits are allocated according to your subscription plan and refresh every month since the start of your paid subscription.
• Credits do not roll over from one month to the next.
• Credits have no monetary value, are not redeemable for cash, and are not refundable.
• We may rate-limit, throttle, or temporarily suspend access to the Feature where usage patterns indicate automated, scripted, or otherwise abusive behaviour.
• You may not:
  • attempt to reverse engineer, scrape, or extract the underlying prompts, model identities, or system instructions used by the Feature;
  • resell, redistribute, or commercially exploit articles generated through the Feature without our prior written permission;
  • create multiple Accounts in order to obtain additional free credits.
• We may adjust credit allocations from time to time with reasonable notice.

5.4 Prohibited content

You must not use the Feature to generate, request, or attempt to generate content in any of the following categories. This list is illustrative, not exhaustive.

Sexual and adult content

• Sexually explicit material of any kind
• Any romantic, suggestive, or sexual content involving minors (zero tolerance)
• Pornographic depictions
• Solicitation or grooming-style content

Violence and harm

• Graphic violence, gore, or torture
• Instructions for violence against people or animals
• Content glorifying or instructing on self-harm, suicide, or eating disorders

Hate, discrimination, and harassment

• Hate speech against any group based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality
• Content targeting individuals for harassment or bullying
• Content promoting extremist ideologies including terrorism or supremacism
• Slurs or dehumanising language

Illegal activity

• Instructions for creating weapons, drugs, or other illegal substances
• Detailed criminal how-to content, including hacking, fraud, or theft
• Content glorifying illegal drug use, drug dealing, or other illegal activity
• Content that violates UK or international law

Misinformation and manipulation

• Deliberate misinformation, including health, medical, legal, or financial misinformation
• Content impersonating real people in defamatory or misleading ways
• Political propaganda or partisan campaigning content

Privacy and personal data

• Content containing real people's personal information, including addresses or phone numbers
• Content designed to identify, locate, or expose individuals

Real people

• Articles about real, identifiable individuals that depict them in defamatory, fictional, or compromising scenarios

Copyrighted material

• Requests for full reproductions of copyrighted works such as song lyrics, books, or scripts
• Requests for articles that closely imitate the distinctive style of a specific living author or commercial work

Religious and culturally sensitive content

• Content that mocks, defames, or disrespects religious figures, scriptures, or practices

Politically sensitive content

• We reserve the right to decline politically sensitive requests at our sole discretion. Our user base is international and we take no political stance on contested matters relating to China, Taiwan, Hong Kong, Tibet, or other politically charged subjects.

Spam and low-effort use

• Generating articles purely for testing, harvesting outputs, or reselling
• Bulk identical or near-identical requests

Inappropriate content for children

• Content framed for children that contains adult themes, violence, or material unsuitable for the implied age group

We reserve the right to decline any request that, in our sole judgment, violates the spirit of these Terms or is inappropriate for a family-friendly language-learning platform, whether or not the request falls within an enumerated category above.

5.5 Articles generated from external content (personal use only)

• You are responsible for the source material you submit. By submitting a URL or pasted text, you warrant that:
  • you have lawful access to the source content;
  • you have the right to process that content for personal language-learning purposes;
  • the source content does not contain material prohibited under clause 5.4.
• We do not verify the copyright status of source URLs or pasted text. Submitting material you do not have the right to use is a violation of these Terms and may also infringe third-party rights, for which you are solely responsible.
• Personal use only. Articles generated under this clause are for your personal language-learning use only. You may not:
  • redistribute, republish, or share these articles outside Mandarin Mosaic;
  • make these articles available to other Mandarin Mosaic users;
  • use these articles for any commercial purpose.
• Limited storage and no sharing. Articles generated under this clause are stored only in your personal Account. They are not added to the shared library, are not displayed to other users, and are not used to train Mandarin Mosaic's models or those of third parties. We may delete or archive such articles after a reasonable period.
• The Feature may decline to process URLs from sources that prohibit automated access (for example, through a robots.txt file or technical paywall) or that contain content prohibited under clause 5.4.

5.6 Articles generated from your prompts or the Mandarin Mosaic library

• Rights in generated articles. To the extent that any copyright or other intellectual property right arises in an article generated under this clause, you assign all such rights to Mandarin Mosaic, or where assignment is not legally possible, grant Mandarin Mosaic a perpetual, worldwide, royalty-free, exclusive, and sublicensable licence to use, reproduce, modify, adapt, publish, display, and distribute the article in any medium.
• Use by Mandarin Mosaic. We may use these articles for any lawful purpose, including:
  • displaying them to other users as part of the shared article library or any "discover" or "interesting articles" feed;
  • using them to improve the platform and the Feature;
  • including them in marketing, demonstration, or educational materials about Mandarin Mosaic.
• No personal information. You must not include any personal information about yourself or any other person in prompts you submit. This includes names, contact details, addresses, identifying descriptions, or sensitive personal data. Articles generated from your prompts may be shown to other users, and we cannot remove personal information you have voluntarily included in a prompt after the fact.
• Opt-out from shared display. You may indicate in your account settings that articles you generate should not be displayed to other users. Where such an opt-out is selected, we will retain the rights granted above but will not include your generated articles in shared user-facing features.

5.7 Content quality and accuracy

• The Feature uses third-party AI models. AI-generated content may contain inaccuracies, factual errors, mistranslations, or content that does not reflect the HSK level requested.
• Articles generated through the Feature are provided for language-learning purposes only. They must not be relied upon as factual sources, news reporting, or as medical, legal, financial, or other professional advice.
• We do not guarantee the accuracy, completeness, HSK-level appropriateness, or fitness for any particular purpose of any article generated through the Feature.
• You are responsible for the prompts and inputs you submit and for any consequences arising from the resulting output. Attempting to use the Feature to generate prohibited content is a violation of these Terms whether or not the Feature actually produces such content.
• The Feature is provided on an "as is" and "as available" basis. We give no warranty as to availability, uptime, or specific outputs.

5.8 Monitoring, logging, and moderation

• To ensure quality, safety, and abuse prevention, we may log and review:
  • prompts and inputs submitted to the Feature;
  • URLs and pasted text submitted to the Feature;
  • articles generated through the Feature.
• We may use automated filters, model-based safety systems, and human review to detect content that violates these Terms.
• Logged data is handled in accordance with our Privacy Policy.

5.9 Rights holder takedown and complaints

• We respect the intellectual property rights of others. If you are a rights holder and believe that content generated through the Feature has been derived from your copyrighted material in a way that infringes your rights, please contact us at [email protected] with:
  • identification of the copyrighted work concerned;
  • identification of the allegedly infringing material with sufficient detail to locate it;
  • your contact details and a statement, made in good faith, that you are the rights holder or authorised to act on their behalf.
• We will review valid takedown requests promptly and, where appropriate, remove or restrict access to the relevant content.
• Users whose generated articles are removed may appeal in writing to [email protected].

6. User Content and Shared Materials

• You retain ownership of custom packs, sentences, and vocabulary lists you create within the Service, except where these are derived from Mandarin Mosaic content or governed by clause 5.6.
• If you choose to share custom packs, sentences, or other materials with other users (for example, via a public share link or community library), you grant Mandarin Mosaic a worldwide, royalty-free, non-exclusive licence to host, display, and distribute that shared material as part of the Service.
• You warrant that any material you upload or share through the Service:
  • does not infringe any third-party intellectual property right;
  • does not contain prohibited content as set out in clause 5.4;
  • does not contain personal information about yourself or others that you would not wish to be visible to other learners.
• We may remove user-submitted content at our discretion where it violates these Terms or in response to a valid complaint.

7. Acceptable Use

When using any part of the Service, you must not:

• use the Service for any unlawful purpose or in breach of any applicable law or regulation;
• use the Service to harass, abuse, stalk, threaten, or defame any person or entity;
• attempt to gain unauthorised access to the Service, other users' Accounts, or our systems;
• interfere with, disrupt, or place undue load on the Service or its underlying infrastructure;
• use automated tools, bots, or scrapers to access the Service except as expressly permitted;
• reverse-engineer, decompile, or disassemble any part of the Service, except to the limited extent permitted by applicable law;
• circumvent or attempt to circumvent any content filter, rate limit, paywall, geographic restriction, or other technical measure;
• copy, modify, or create derivative works of the Service or its content, except as expressly permitted in these Terms.

8. Intellectual Property

• The Service, including its software, design, content libraries, articles, audio, teaching methods, and trade marks, is owned by Mandarin Mosaic or its licensors and is protected by intellectual property laws.
• Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own language learning.
• You may not redistribute, resell, sublicense, publicly display, or commercially exploit any part of the Service or its content without our prior written permission.
• Where the Service incorporates open-source software, your use of that software is also subject to the applicable open-source licence.

9. Third-Party Services and Content

• The Service may link to, display, or integrate with third-party services, websites, or content (for example, payment processors, AI model providers, dictionary APIs, or pages linked to from the AI article generation feature).
• We are not responsible for examining or evaluating the content, accuracy, availability, or practices of third-party services, and we are not liable for them.
• Your use of third-party services is at your own risk and may be governed by those third parties' own terms and privacy policies.
• Data displayed via the Service or any external service, including but not limited to medical, legal, financial, or location information, is for general informational purposes only and is not guaranteed by us.
• We may change, suspend, restrict, or remove access to any third-party integration at any time without notice or liability to you.

10. App Store and Apple-Specific Terms

The following terms apply where you have downloaded the Mandarin Mosaic app from the Apple App Store and are in addition to, not in place of, the rest of these Terms. To the extent of any conflict, the Apple-specific terms in this section take precedence over the equivalent general clause in these Terms.

• Acknowledgment. These Terms are concluded between you and Mandarin Mosaic only, and not with Apple Inc. ("Apple"). Mandarin Mosaic, not Apple, is solely responsible for the app and its content.
• Scope of licence. The licence granted to you for the app is a non-transferable licence to use the app on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
• Maintenance and support. Mandarin Mosaic is solely responsible for providing any maintenance and support services for the app, as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services for the app.
• Warranty. Mandarin Mosaic is solely responsible for any product warranties applicable to the app, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of Mandarin Mosaic.
• Product claims. Mandarin Mosaic, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including: (a) product liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
• Intellectual property rights. In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, Mandarin Mosaic, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.
• Legal compliance. You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Developer contact. Questions, complaints, or claims regarding the app should be directed to: [email protected].
• Third-party terms. You must comply with applicable third-party terms of agreement when using the app (for example, your wireless data service agreement).
• Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

11. Disclaimers

• The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Mandarin Mosaic disclaims all warranties of any kind, whether express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
• We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• Language learning results vary by individual and are not guaranteed. The Service is an aid to study; it does not replace formal language instruction or professional certification.
• Translations, definitions, example sentences, and HSK-level classifications provided through the Service may contain errors. They are offered as a learning aid only and should not be relied upon for professional, legal, or business purposes.
• Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable consumer protection law.

12. Limitation of Liability

• To the extent permitted by law, in no event will Mandarin Mosaic be liable for any indirect, incidental, special, consequential, or exemplary damages, including without limitation loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use of or inability to use the Service, however caused and regardless of the theory of liability.
• For all claims arising under or in connection with these Terms or the Service, our total aggregate liability to you in any twelve-month period is limited to the greater of (a) the total amount you paid to Mandarin Mosaic for the Service in that period, or (b) fifty pounds sterling (£50).
• We are not responsible for technical issues on your end (for example, your device, internet connection, or third-party software) that affect your ability to use the Service.
• Nothing in this clause limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded by law.

13. Indemnification

You agree to indemnify and hold harmless Mandarin Mosaic, its officers, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• your breach of these Terms;
• your misuse of the Service, including the AI article generation feature;
• content you submit, generate, or share through the Service;
• your infringement of any third-party right, including intellectual property and privacy rights.

14. Suspension and Termination

• You may stop using the Service and close your Account at any time.
• We may, at our sole discretion, suspend or terminate your Account, refuse to process any request, or remove or restrict access to any content where we reasonably believe you have breached these Terms.
• Grounds for suspension or termination include but are not limited to:
  • repeatedly requesting or generating prohibited content;
  • attempting to bypass content filters, rate limits, or safety systems;
  • creating multiple Accounts to circumvent credit limits or other restrictions;
  • submitting source content you do not have the right to use;
  • using the Service to harass, defame, or harm any person;
  • non-payment of subscription fees.
• Termination does not entitle you to a refund of subscription fees or credits already consumed, except where required by applicable consumer law.
• Clauses that by their nature should survive termination — including clauses relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive termination of these Terms.

15. Privacy and Data Protection

• Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms.
• You have rights under the UK GDPR and other applicable data protection laws, including the right to request a copy of your data or to request that it is deleted. To exercise these rights, contact us at [email protected].
• We collect anonymous usage statistics (such as packs studied, cloze test results, and sentence rankings) to improve the Service. This data is not used to personally identify you.

16. Age Requirements

• The Service is intended for users aged 13 and over. Users between 13 and the age of digital consent in their jurisdiction should only use the Service with parental or guardian consent.
• The AI article generation feature is intended for users aged 13 and over. Users under 13 should use the feature only with parental supervision.
• Where applicable law sets a higher minimum age for the processing of personal data or the use of online services, that higher age applies.

17. Modifications to These Terms

• These Terms may be updated from time to time.
• Material changes will be communicated via email and posted on our website with a new "Last Updated" date at the top of this page.
• Continued use of the Service after the updated Terms take effect constitutes your acceptance of those updated Terms.
• If you do not agree to the updated Terms, you must stop using the Service and may close your Account.

18. Export Controls

You agree not to use, export, or re-export the Service in violation of any applicable laws or regulations, including export control laws of the United Kingdom, the European Union, and the United States. In particular, the Service may not be used by, or exported to, anyone on any U.S. Government list of prohibited or restricted parties, or to any country subject to applicable trade sanctions.

19. General

• Entire agreement. These Terms, together with our Privacy Policy and any feature-specific terms referenced here, constitute the entire agreement between you and Mandarin Mosaic regarding the Service.
• Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
• No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
• Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to any successor in interest.
• No partnership. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Mandarin Mosaic.
• Force majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control.

20. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Subject to any mandatory consumer protection rights you may have under the law of your country of residence, any dispute arising out of or in connection with these Terms will be resolved through the courts of England and Wales.
